OPM Email Server Sparks Lawsuit & Emergency Motion
Federal Employees Demand Immediate Shutdown Over Privacy Concerns

Two federal employees have filed an emergency motion calling for a temporary restraining order against the Office of Personnel Management (OPM), alleging the agency is using an unauthorized commercial server to send mass emails to the entire federal workforce. The lawsuit claims OPM, under directives from a Trump-appointed special government team led by Elon Musk, bypassed federal laws and security protocols to set up the server without a privacy impact assessment.
The contested server, which has reportedly sent controversial emails offering deferred resignations to federal employees, is accused of storing personal data without oversight. Plaintiffs argue that the server’s continued operation puts sensitive information at risk, potentially exposing millions of government workers to cyber threats.
House Democrats have demanded answers, pressing OPM for technical details, procurement records, and a full security review. As the legal battle intensifies, the plaintiffs fear retaliation, pushing for anonymity in court filings. Meanwhile, critics argue that the administration’s reckless handling of government data endangers national security, with potential exposure to foreign adversaries. Will the court intervene before the February 6 deadline.
